1. Scope of the Privacy Policy

This policy, effective December 31st, 2019 covers our treatment of personally identifiable information ("Personal Information") that we process when you are accessing or using our Services. It applies to all Gelvio members, users, consumers, job applicants, and to all Gelvio platforms, including Company applications, websites and subdomains, features, content, products, email distribution lists, and other services offered by Gelvio (collectively, the “Services”). Additionally, use of the Services is also subject to Gelvio’s Terms and Conditions.

2. The Information We Collect

When you use Services provided by Gelvio, we collect and receive information in various ways. We collect information provided by you, usage information, and information about your devices. Here is an overview of the types of information we collect:

2.1  Information You Provide Us

We receive the information that you provide us when engaging with Gelvio, such as when setting up your account, communicating with us, posting reviews, or applying for a job. Additionally, if you connect one of your social networks to your Gelvio account, you are authorizing the social network to share your information with Gelvio.

2.2 Internet-Related Information We Collect

We collect technical information when you use our Services on a web browser, computer, or mobile device. We use this information to improve the Services.

Technology Information. We receive information related to your IP address, operating system, personal setting, and Services usage. Your device, browser, and software settings affect what information is available to us, and how we are able to deliver Services to you.

Business contact data. We collect information related to current and prospective business partners. Such information includes, but is not limited to, employees, owners, directors, contractors, business activities, and business conduct.

Cookies, Analytics, and Third Party Technologies. We collect information through the use of “cookies”, tracking pixels, data analytics tools, and other third party technologies to understand how you interact with “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device. Information or materials: If you choose to submit any information or materials to us including, without limitation, testimonials, ratings and reviews, product feedback, data files, written text, computer software, music, audio files, photographs, videos, and other images, we may use the Personal Information you share, if any, for business purposes.

Third party services provide us with information needed to offer you our Services. Such third-party services include payment processors, marketing service providers, fraud screening, and other businesses. We may obtain the following information about you: (1) Information, such as your IP address, interactions with our website and payment processing; (2) Information about your participation in third party programs that provide things such as payment, transaction, and fraud detection information; (3) Information related to social media, demographic, and geography; (4) For job applicants we may do an online search of you and review information as available. We may also perform background and reference checks, as consistent with applicable law. 

3. How We Use your Information

We may use collected Personal Information any of the following purposes:

  • To assist you with your use of the Services.
  • To process your purchases, transactions, payments and prevent transactional fraud. We may also save your Personal Information to facilitate recurring orders, new orders, or process returns.

We may share your Personal Information with third parties, such as service providers and vendors, for legally permissible reasons, so that we can offer you our Services.

4.1 Sharing Information With Third-Party Service Providers

Gelvio may share the following categories of your Personal Information for business purposes:

  • Commercial Information. We collect and store this information to protect against fraud by ensuring that we have accurate data related to historical purchases.
  • Identifiers. We collect and store this information in order to verify your identity, prevent fraudulent transactions, enable purchases, and enable delivery.

4.2 Information that’s not personally identifiable.

We may create anonymous data from your Personal Information. We make Personal Information into anonymous data by removing any personally identifiable information. We may use this anonymous data and share it with third parties for lawful business purposes.

4.3 Legal & Safety Reasons

We reserve the right to access, review, maintain, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of Gelvio, our employees, or others.

4.4 Business Transfer 

We may share Personal Information in relation to a sale or purchase of assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. If Gelvio, or Company assets, are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party. The receiving entity would be bound to comply with the terms of this privacy policy for all Personal Information collected under this policy.

5. Storing & Protecting Your Information

We are committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. However, no information system is fully secure, so we are unable to guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information you transmit to the Site over networks that we do not control, including the Internet and wireless networks, and please be aware that you provide us with information and data at your own risk. You are responsible for keeping log-in credentials secure and confidential. Contact us if you have reason to believe that your log-in credentials have been compromised.

6. Other Third-Party Websites

Our Services may contain links to third-party websites and other services. Linked third-party websites and services may have privacy policies that are different from Gelvio’s. We are not responsible for those websites or services, and we recommend that you review their policies.

7. Your Rights and Choices Regarding Your Data

Email Subscriptions. You can unsubscribe from commercial or promotional emails by clicking unsubscribe in messages. You will receive transactional and relational emails about use of our Services.

Cookie Tracking. You can modify your cookie settings on your browser, but if you delete or choose not to accept our cookies, you will be forgoing features of our Services.

Account Information. You can review and edit account information on your account page.

Deleting Your Account. You may request termination of your account or deletion of certain information by emailing In some cases, we will be unable to delete your account for security purposes. If deleting your account is possible, we may retain certain information for business purposes or to comply with legal or regulatory obligations.

Do Not Track. Some web browsers may transmit “do-not-track” signals to the website with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

California Privacy Rights. Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), California residents may have additional data privacy rights, such as the right to be notified about what personal information is collected about you, and our intended use and purpose for collecting your personal information. California residents have the right to know and access personal information we have collected, used, disclosed, or sold about you over the past twelve (12) months, including the categories of personal information we have collected, used, disclosed, or sold about you; the categories of sources from which the personal information is collected; and, the business or commercial purpose for which your personal information was collected, used, disclosed, or sold; the categories of third parties with whom we have shared your personal information. California residents have the right to request Gelvio to transfer, to the extent feasible, personal information in certain forms and formats. California residents have the right to request that we (and any applicable service provider) delete/erase your personal information under certain circumstances.

California residents have the right to opt-out of the sale of their personal information. Gelvio does not sell your personal information to third parties for profit. However, we do use third party tools and such relationships may involve the disclosure of your personal information for “valuable consideration” as set forth in the CCPA. Our Site is not directed and should not be used by minors under the age of 18 and therefore Gelvio does not knowingly sell the personal information of minors under 18 years of age without affirmative authorization.

California residents have the right not to be subject to discrimination for asserting their rights under the CCPA. If you make, or an authorized agent on your behalf makes, any request related to your personal information under the CCPA, Gelvio will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required under the law before addressing your request. Gelvio may require you to match two or three pieces of personal information we have previously collected from you before granting you access to, or erasing, specific pieces, or categories of, personal information, or otherwise responding to your request. We may also require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the request.

8. Data Retention and Localization

The information that Gelvio collects and processes is stored in the United States. If you are located outside of the United States, please be aware that information you provide to Gelvio will be transferred to the United States, and that the United States may provide a different level of data protection relative to the laws in your local country. By continuing to provide us such information you hereby consent to your personal information being transferred to, and stored in, the United States. Your information will be stored in a secure environment.

9. Children’s Data

Gelvio does not knowingly collect or solicit personal Information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Services or send any Personal Information about yourself to us. If we learn that we have collected Personal Information from a person under the age 18, we will delete that information. If you believe that a child under 18 may have provided us Personal Information, please contact us.

10. Changes to this Privacy Policy

As our Services change, we may periodically change this Privacy Policy. Continued use of the Services after a change to this policy will be governed by the new terms.
